Terms of Service

1. Acceptance of Terms

By accessing or using Proof of You ("PoY", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Proof of You Inc. ("we", "us", "our"), a Delaware corporation. We may update these Terms from time to time, and your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. The Service

Proof of You provides the following services:

• Human Verification - biometric-based proof that a user is a real human being, without revealing their identity
• Content Stamping - cryptographic proof that a verified human created or approved specific content
• Trust Scoring - a reputation metric calculated from your verified activity on the platform
• API Access - programmatic integration of PoY verification into third-party applications

The Service is provided as a platform tool and does not constitute legal proof of identity, legal certification, or government-recognized identification.

3. Account Registration

To use most features of PoY, you must create an account. When registering, you agree to:

• One account per person - each individual may maintain only one PoY account. Creating multiple accounts to circumvent restrictions or inflate trust scores is prohibited.
• Accurate information - you must provide truthful, current information during registration
• Credential security - you are responsible for maintaining the confidentiality of your login credentials and API keys. You are liable for all activity that occurs under your account.
• Prompt notification - you must notify us immediately at security@proofofyou.com if you believe your account has been compromised

4. Acceptable Use

You agree not to use the Service to:

• Impersonate another person - enrolling with someone else's biometric data or claiming to be someone you are not
• Commit fraud - using PoY verification to deceive others about your identity or intentions
• Automate abuse - using bots, scripts, or automated tools to interact with the Service in unauthorized ways
• Circumvent verification - attempting to bypass, manipulate, or forge verification results
• Disrupt the Service - launching denial-of-service attacks, exploiting vulnerabilities, or interfering with other users' access
• Violate laws - using the Service in any way that violates applicable local, state, national, or international law

5. Biometric Enrollment

The PoY verification process involves biometric enrollment. By enrolling, you acknowledge and agree to the following:

• Voluntary participation - enrollment is entirely optional. You may use limited features of PoY without biometric verification.
• On-device processing - all biometric processing occurs on your device. Your raw biometric data (face, voice, fingerprint) never leaves your device.
• Hash-only transmission - only a one-way SHA-256 hash is transmitted to our servers. This hash cannot be reversed to reconstruct your biometric features.
• Right to delete - you may delete your biometric hash at any time by deleting your account or contacting privacy@proofofyou.com.

6. Content Stamping

• Ownership - you retain full ownership of any content you stamp through PoY. Stamping does not transfer any rights to us.
• Permanent records - content stamps create permanent, immutable records on our platform. Once stamped, a record of the stamp (timestamp, hash, your PoY ID) cannot be removed. You may delete your account, but the stamp record will be anonymized rather than deleted.
• Rights representation - by stamping content, you represent and warrant that you have the legal right to do so. You are the creator of the content or have authorization from the creator.
• No content storage - we store only a cryptographic hash of the content, never the content itself.

7. Trust Score

• Automatic calculation - your Trust Score is calculated automatically based on your verified activity, including successful verifications, content stamps, and account age
• Not a credit score - the Trust Score is not a financial credit score, background check, or character assessment. It reflects only your verifiable activity on the PoY platform.
• Not transferable - Trust Scores are tied to individual accounts and cannot be transferred, sold, or assigned to another person
• Third-party use - third-party services that integrate with PoY may use your Trust Score as one factor in their own decision-making, but PoY is not responsible for how third parties interpret or act on your score

8. API Usage

If you use the PoY API, the following additional terms apply:

• Rate limits - API calls are subject to rate limits based on your subscription plan. Exceeding your limits may result in throttling or temporary suspension of API access.
• API key confidentiality - your API keys are confidential credentials. Do not share them publicly, commit them to public repositories, or embed them in client-side code.
• Responsible integration - you must implement proper error handling, respect rate limits, and cache responses where appropriate
• Attribution - if you display PoY verification results to end users, you must clearly indicate that verification is provided by Proof of You

9. Paid Plans

• Billing - all paid subscriptions are billed through Whop.com. By subscribing to a paid plan, you also agree to Whop.com's terms of service.
• Cancellation - you may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
• No partial refunds - we do not offer refunds for partial billing periods. If you cancel mid-month, you retain access until the end of that billing period.
• Downgrade policy - if you downgrade to a lower plan, all existing stamps and verification history are preserved. You retain access to your data but may lose access to premium features.
• Price changes - we will provide at least 30 days notice before changing subscription prices for existing customers

10. Intellectual Property

The Proof of You name, logo, brand assets, website design, underlying technology, algorithms, and systems are the exclusive property of Proof of You Inc. and are protected by United States and international intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of our proprietary technology, unless applicable law gives you the right to do so.

11. Disclaimers

• Verification is probabilistic - PoY verification provides a strong indication of humanness but is not absolute or infallible. No verification system is 100% accurate.
• Not a legal identity document - PoY badges and verification results do not constitute government-issued identification and should not be used as a substitute for legal identity verification where required by law.
• Service availability - we strive for high availability but do not guarantee uninterrupted access to the Service

12. Limitation of Liability

To the maximum extent permitted by applicable law, Proof of You Inc., its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, whether caused by tort (including negligence), breach of contract, or otherwise, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) one hundred US dollars ($100).

13. Termination

• By us - we may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the integrity of the Service. We will provide notice where practicable.
• By you - you may delete your account at any time through your account settings or by contacting privacy@proofofyou.com. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.
• Effect of termination - upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and dispute resolution.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.
